02 Core Applicable Rules of the New York Convention

The Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention) is the core basis for global cross-border arbitration enforcement, applicable to more than 160 contracting states worldwide. As a contracting state, China recognizes and enforces legitimate arbitration awards made by domestic arbitration institutions in all contracting states. Overseas compliant arbitration awards can also be applied for recognition and enforcement in domestic courts.

03 Preconditions for Cross-border Enforcement

The arbitration agreement is legitimate and valid without invalid or revocable circumstances. The arbitration institution and procedures comply with bilateral agreements and statutory rules. The award content does not violate the public interests and mandatory legal provisions of the enforcement state. The award has taken effect without suspension or revocation. The award and arbitration agreement have completed compliant notarization, authentication and translation procedures.

04 Common Circumstances for Enforcement Rejection

Invalid arbitration agreement or parties without civil capacity; illegal arbitration procedures without legal service and guaranteed defense rights; award content beyond the scope of arbitration agreement; award violating the public order and mandatory laws of the enforcement state; award not in effect or revoked by the court of the arbitration place.

05 Practical Cross-border Enforcement Suggestions

Prioritize well-known foreign-related arbitration institutions for cross-border transactions and agree on valid arbitration clauses. Strictly abide by procedural norms during arbitration and retain full procedural evidence. Complete notarization, authentication and compliant translation of award documents promptly after winning cases, and accurately align with judicial rules of the enforcement state.
